FERPA letter was sent to school 3 weeks ago to obtain records for children. I have joint legal and EOW. School is a Catholic school in DE. I have had no response to the letter, but found out via phone call from ex that the principal approached ex and notfied her that I sent the letter to obtain records. Ex was told details about what the letter was requesting.

1. Do private schools have to adhere to this policy?
2. Is it typical for a school to share requests for this information with the other parent?

Thank you

If the private school receives Federal money for educational purposes, then it is subject to Federal law and must comply with FERPA. If the school is entirely funded from private money, then the school can drop your letter in the trash, except if your court order or a State statute expressly grants you the right to receive information regarding the child, or your court orders grant you joint legal custody.

Private schools have their own policies. I can't comment on what's typical -- sorry.
