My boyfriend is currently paying 375 a month in child support, in the state of Maryland even though he has his daughter every other week and is responsible for all expenses incurred during that time.  In January he will be a full time student and his age is 25.

1) If you are a full time student do you still have to pay child support?

Not be sound like an idiot but if he is going to school full time how is he to pay child support.  We aren't married but I am supporting him 100% while he is in school.

1) How can the courts order him to pay what he technically doesn't have?

2) He already has her every other week so will going to school full time effect that?

The duty to pay support is primary. Everything else is subordinate, unless the court finds that a different result is in the child's best interests.

So, unless you can convince the court that your schooling will operate reasonably quickly to advance the child's best interests, then the court will assume that you are voluntarily unemployed, and order you to pay support based on what you could reasonably earn were you not attending school.

And, if you don't pay, the judge will order you to seek work, and if you don't seek work, then the judge will start sentencing you to jail time or community service until you change your mind.

I don't understand the question.
