i got my daughter on friday like i always do , but on sunday when i went to take my daughter back i came to found out her mother left the state. how do i wait till i file for sole custody since her mother abandoned her ? PLEASE help a loving caring father

i was wondering can i file for child abandonment . my ex girlfriend left the state on my weekend, i went to take my daughter back on sunday only to found out her mother left the state do i have a waiting period before i can file for sole custody? the children services was looking into to her fro drinking an doing drugs in front of my 5yr daughter whick i was jsut in court an the judge made it in the court papers she was not to be drinking or doing drugs in front of our daughter but she was still doing it can you PLEASE HELP ME !!!!!!!!!!!!!!!!!!!

i;m in the process of trying to get custody of my 5 yr daughter ciara, from her mother who is using drugs an drinking all the time , when we will in front of the judge she said she didnt drink or do drugs but as soon as the hearing was over she was in the bar her soon to be ex husband saw her an she got pulled over that night she had my daughter in with her an not buckled up . we go in front of another judge on feb 9th we also have child services looking her to her homelife cuz my daughter is drawing pictures of crack pipes that her mother has hiding in her pocketbook also when we were in front of ther one judge he wrote into the custody papers that noone is top be drinking around ciara but her mother still does it, also we have her sister as witness to how she treats ciara also her soon to be ex husband is on our side to an will testify also her son who she treid to pawn ciara off on him to raise but not to let me know an she would split the child support with him do i have a good case??? or do i need a lawyer which i cant really afford can you help me ,a father at his wits end!

let me start at the beginning , i had a child to a married woman she was lying to me from the start , saying she wasnt with her husband anymore but when my daughter was born her husband signed the birth certifiacte because she told him he was the father she told me she would put me down as my daughter ciara's father on the papers but she didnt , i was always in my daughters life from the start i watched her everyday for the first year of her life then i would see her every day when i would stop at her grams house, then i got engaged an she wents crazy she went an took me for child support so i had a dna test done to be sure an yes she was my child i gladly pay child support only wishing my daughter got the money instead of her mother, well i have her everyother weekend an some weekends that are mine. but lately her mother is doing drugs again an she called her own son an asked him to quit college to come back up here an raise my daughter ciara an she would split the childsupport with him because she told him she just wants to be with her boyfriend an do her drugs an of course he said no give her to her father,but she would because of the money an she told her son she would send ciara away like she did with him ,she has two boys either of them did she not ever raise, well her son called us right away an told us everything she even tryed to paWN my daughter off her own mother but her mother said no she belongs with her father , she is never at home she is always out drinking an doing drugs an leaves my daughter with her husband. well her sister called an told me the house is a mess an dirty an she is not taking good care of ciara so she an went into childrens youth services to turn in her, because pry to all this my daughter said her half brother was touching her pee bugger ab her butt i called children services then an they are looking into but how can i get my daughter to come live with me she wants she crys whne she has to go home she sayd she wants to live here . she saw her mother go after her stepdad with a knife i want her out of the life can you PLEASE PLEASE HELP ME!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

i had  daughter to a married woman i have vistion an pay child support, but things have been going on where my daughter lives that i feel for her welfare . her mother called her brother an ask him to quit school an move up here an take care of my daughter ciara an she wouldnt tell me an she would split the child support with him because she told him she was doing hard drugs again an had a new boyfriend an didnt want ciara anymore but wont let me have her , her own sister has called me an told me she is going all night an drinking an doing hard drugs an leaves my daughter with her stepdad all the time he wanted to call me the other night to come an get her but nobody would give him my number, she also asked her mother to take ciara when her son said no that ciara should go to her father, but her mother said what if i found out an my daughters mother said she would lie an tell me she was living there to she was going to split the child support with her but she said no too. an when her son said no she said she would pawn her off like she did to him when he was younger she has two other children an doesnt care for them their grandparents do . also prior to this my daughter said her brother was touching her pee bugger an butt, i called chidren sevices an they are looking into it , an on tuesday i & her sister are going to children services because she fears for the safety of my daughter . i need help to get my daughtery to live with me an my wife who she calls mommy where she will have stable home do i have any rights ???
