Title: Wife took son to Oregon

Wife took son to Oregon and filed for divorce in California.  What do I do/

Hi,

I'm happy to respond, but need more details.

1.  How long ago did she file?

2.  How long ago did she move?

3.  If she filed in California, and if you've been served, you may wish to see if your papers include a restraining order against taking child out of state.  Look carefully over all of the forms that you got.

4.  If your paperwork includes that restraining order, you may want to get an attorney ASAP to see if you can get immediate custody on the grounds that the mother violated the restraining order.

5.  Biggest question is... you're getting divorced, whether you want it or not.  What would be the ideal outcome for you (i.e., finances and frequency of seeing your son)?
