Title: Clarification of CO
Post by: kitten on Oct 29, 2004, 10:12:38 AM
Hey, Soc!

We are in CA.  CO dated 04 JUN 28 states:
"October 31 care, custody and control shall be with the mother from 5:00pm until 8:30pm in odd numbered years to alternate between the parties each year thereafter."

1. Obviously it is an even # year, visitaion is with father this year. Correct?

2.  BM acting and talking as if SHE has them.  Father should arrive with CO in hand?

3.  BM may either not be home or refuse.  What can he do in that case?

Any other suggestions to make this as easy on the kids as possible would be appreciated!

Thank you!

Yes.

Yes. But I'd call first and just tell the other parent that you intend to be there at 5pm. Don't say what you will do if she doesn't comply with the orders, just make sure that you have an objective witness (not you, or a relative), or a tape recorder running and held in plain sight.

You need an objective witness to testify that you attempted to exercise custody at the date and time in the court order. You can call the sheriff, and have them appear and file a report.

Frankly, kids are incredibly flexible when compared to their parents. Exercise your rights with a minimum of fanfare and no hostility visible.
