State of Florida


is it legal for a custodial parent who recieves child support and is newly married to get state assistance...such as reduced housing, food stamps etc...?

she better have a good excuse for not paying child support and if she hasnt made any attempt to visit the children, i dont know what her reasons would be to change the status quo.

 be very careful the courts are bias when fathers have custody but, it sounds like you dont have anything to worry about.

unless she can prove that the its not in the childrens best interest to continue to reside with you, then you should be awarded primary residence(custody) especially if you can show that the children are doing well and thriving.

not sure about carolina but, in florida they can go after one or both parents , although both have a obligation to pay support. My guess is that the state will go after who ever has money and in this case it sounds like the bio mom, leaving the bio mom with the burden of recouping the other half from the father...think of them like a collection agency even though both have there name on the credit card they will go after who is the easiest to collect from or most likely to pay.

You might be able to get an order at an imputed amount on your x's earning capacity based on previous employment.

in florida if you are $5000.00 dollars in arears your license can be suspended or (if you refuse to date one of the staff)......long story

I am finally getting the hearing I so desperatly tryed to schedule but, but, now I need to amended some parts of it.

1. when filing an amended petition does it have to be completely redone or can I just amend the sections that need to be amended?

Hello I found some one with a similar problem thay got custody of there son and prior to this was behind in support for 2000.00 dollars, the judge ordered support for her and said that since he owes her it will offset her past due support. and ordered it as such.

the judge also told her to make copies and send them to the dept of revenue, she going to give me her final orders tomorrow.

It only makes since to me, you cant have laws without mercy and the only place you can expect mercy is from the lord and hopefully a court judge concerned about it's citizens and children and also to protect them from the states oppression. anytime you forget about whats best for the childrens and make money at there expense is just as bad as a preditor using and exploiting them.

I have had custody for the past 5 years. so what your saying is the dept of revenue will collect from me and just hold it? there is no one for them to send it to.  (the other parent was found by the court to have neglected these children and step parent was arrested twice for lewd and lacivious on the children. they have since fled the country)


the other parent is in arrears now and the dept of revenue should freeze, levie against the other parents assets as well. but there are no assets......except the unclaimed child support and that should be sent back to me...right?

yes, according to the dept of revenue for child support enforcement, however, I am now the custodial parent for the children and have been so for the past 5years.

child support that is  taken from this family is for the benefit of the children but, it cant benefit the children. only hurt them, because it takes away from there care, as it is taken from the home that they reside it.

in the original order the court files reflects percentage and  amounts of support obligation from each parent.

the other parent has an obligation of support and the amount of there obligation would offset the amount the dept of revenue is claiming i owe and in fact put's the other parent in arrears.

  freezing 100% of one's desposible income in itself cannot be legal?
these children have doctors appointments, medicine that has to brought,
etc.

Yes, there was a past due amount that was alledged and the court put it in what they called "reserved" aftyer the court recalculated the amount which was 15,000 less then what the dept of revenue was claiming.

the dept then said it was assistance the other parent recieved but, that turned out not to be the case due to the fact that any assitance had been settled.

now it's alledged to be past support, however the other parent owes a duty of support to me and the amount of obligation is reflected in the original court order.

Thanks, It appears the dept of revenue is trying to keep my case from being heard by a judge.  There trying to force me into an agreement with them. I know if I do this it will undermind my case when presented before a judge. I also know that the dept of revenue could careless what happens to my kids, the only place i can find(hope to find) relief is from the courts regarding my custodial children
