Title: Here is the situation:

My SD16 has not been in school for about a yr now and has been in 3 rehabs since then.  She is supposed to be getting her GED but as of yet does not have it.  My DH is paying child support and has been all this time.  BM has never contacted the child support agency and let them know that SD16 was not attending school, nor that she was in a rehab, but BM was still collecting child support payments the entire time.

Can BM collect child support whne the child isn't in her custody?

Does BM have the right to collect child support if the child has decided to drop out of school?

The problem you will run into is 'emancipation'.  Even tho she's quit school and doesn't live with the mother, it doesn't mean she's self-sufficient, and that's the criteria for emancipation of a minor.  A lot will depend on what your state laws are, but I recommend talking with an atty. just to get an idea of what your CO says compared to state law.
