Title: what guidelines are used for child support for self employed people
Post by: brokenpromises on Oct 11, 2004, 01:00:10 PM
My soon to be ex-husband is self employed.  How is child support calculated in this case?  Do we go by the gross amount minus all deductions?  Please advise!:o

The tax filing of your Schedule C or a K-1 on your 1040.  The hard part, and the part you'll bicker over, is the fluctation of income.  Be prepared for lots of haggling...especially if your husband is earning below his industry (because of start up years) or below his current job.

Thanks for your help.   We are thinking about mediation.  I was just trying to make sure that the amount that we are thinking about is fair.  i Think that we can agree.  Well, I will probably be the one agreeing so that we will not have to fight about it.  I will let some of the properties go, but  I just want to make sure I get the right amount of child support.

Actually, it depends on the state.

Some will use "net"income and some "gross" income (GA for example).

Research your state's laws (or call DHR and ask them -- they should tell you).
