I'm not a lawyer, but this probably would be considered a "change of circumstance" and you might be able to file for custody?? Perhaps even get an exparte order??

But, I am wondering if going to the DA with this could get you some help.....she should be formally charged with abuse...
All that visiting her 3 times a week will do is ensure the bruises dont show..and that things are in order when they visit.
Does your son have behavior issues? Is he in school? You can request for a behavioral specialist to work with him...I dont know what steps need to be taken exactly, I know there is a program over it..and they are more likely to let the money lose for it if it comes from the school then the parent...
Regardless of what the reason is...she is abusing that child and has no right to....I would DEMAND that action be taken, if I had to go to the DA, file a lawsuit against DCS for not protecting your son's interest, talk to the newspapers, whatever......
Also go hire a kicka$$ Lawyer who is a Board Certified Family Law & Custody Specialist. Then ask him/her to file an exparte order giving you temporary custody pending psych evaluation, a home study & anything else he can throw at her.
Go to the school & find out what they have noticed. Make sure they note any improvements in his behavior &/or learning responses after being placed in your care.
With the right lawyer & hopefully a good judge, you should get custody. Take pictures of your home, the boy's room, the yard, his play area, you & him playing together, outings, etc. Give them to the lawyer.

You might also call the police for a welfare check. Tell them that you are concerned about him being locked in his room. If they go there after what should be his bedtime & find the door locked, they will call CPS & hopefully you.
