I am looking to have the primary physical custoday removed from out joint custody agreement. My 11 yr old son is with me over 1/2 the time almost every week. He dislikes her "partner" and he has no interaction with her. He loves his Mother but the lover is making him uncomfortable. His Mother and her lover are doing what they can to try and allow me less contact. I am not allowed on their property to pick him up.

I am looking for any available information..preferably NY State decisions, etc... This is not just a case about her sexuality, I know that is a lost cause, it is about a boy needing a male influence. Why should I pay her when he is with me more? Thanks in advance. I am looking for case law.

I too live in NY but my DH has had custody since 1999.  His Ex had a girlfriend that she bragged to him about but has since gone back to men.  Anyway you might want to go to your local library or law library and look up cases that way.  Or do an internet search for it.  The only other option you may have is to take it back to court and make sure you have it documented how much time he spends with you.
