My daughter is 13, her mom has primary custody and lives in a different county. My daughter wishes to live with me now, her dad.......has for a few years. Daughter is now here w/ me for summer visitation.
My question is where do I file the motion to change primary custody? My county or her county?

I don't know the answer to your question, but if you ask the free legal aid clinic in your county, they can at least point you in the right direction.. Sorry I couldn't help anymore than that...
I think you would have to file in the county the existing orders are in since the child has not lived with you for 6 months, the county that has the current orders should have jurisdiction (sp), at least that is how I have understood it.

Thank you, everyone. I'll file down in her county then. They have jurisdiction still....where the divorce was finalized. Just wanted to make sure.
