Title: Specific Question RE: Paper Wording......
Post by: belle on May 07, 2009, 09:29:13 AM
Husband papers say "Wife shall have care, custody, and control of parties minor children". Also, "Husband in no way relinquishes any parental rights regarding the parties' minor children."

What exactly does that mean. The words Sole custody do not appear anywhere in the papers. Does the above wording mean that she has Sole custody?

Thanks

I would assume so.

In some states, the state laws come into play if the court orders are silent or do not specifically address a matter. If you are unclear, get a free consultation with an attorney - usually 1/2 hour.

If you are looking for clarification because the CP is using this portion of the order to be a "gatekeeper" and otherwise deny access to the child, you need to return to court and get the order CLARIFIED. Ask for specific times and days for visitation, or specific conditions.
