Long story short, ex will not allow me to see my daughter, 3mo old. Thinking about temporary custody order. Wondering if anyone knows if i can file without having physical custody of child. Neither one of us has petitioned the courts yet. Im going to do that this week, but trying to get an advantage and having trouble finding info on temp custody. Thanks
There has to be a GOOD reason for a judge to give you temporary custody. Just because BM (birth mom) is not letting you see the child is not a good enough reason.
You should file a petition is family court for custody (joint legal or physical) and for visitation rights.
