Need a little more information to help...
Are you and ex in same state? How far away are you from child?
Have you ever gone to court over custody before?
Do you have a visitation plan?
Are you on the birth certificate?

Let us know and we can give you the procedures to file in your state.
Usually, you go to family court and file joint custody with visitation rights. This gives you an exact schedule of when you get child. It would be YOUR visitation and not your mothers. Grandparents usually do not get visitation through courts. You will not get sole custody since she has child now so you would be filing for joint custody.

Also, were you married?
How old is the child?
Does the child already have a relationship with you?
