My brother lives in central florida, his exwife has primary custody on paper, but both children have been living with my brother at my mothers house since nov of 2003 when their mother was kicked out of her boyfriends house. (they have been divorced for 4 years she has been mariied 2x since then and have lived with 2 other men and has another baby) My brother cant afford an attorney and is still paying $1000.00 even though he has the children
I hope your brother has been DOCUMENTING, DOCUMENTING, DOCUMENTING.
I don't know about Florida Family Law, but seems like 6 months is the magic number to have the child in your custody before you can file for permanant custody.
The link for Florida Law is below. You might want to check this out.
