Title: How to stop from taking child?
Post by: marcopolo on Jun 13, 2012, 06:09:31 AM
What's the best way to prevent my spouse from
taking my child when they move out of the family home?

It's hard to do, but you can go before a judge and ask for an order preventing the child from being removed from his/her home environment (ECE, or "Established Custodial Environment").

Well I was able to take off on vacation while W moved out.
We had a short hearing, and orders for temporary 50/50 until the scheduling conference.
I'm doing my best at being a good dad during the summer, taking child to day camp
and picking up, as well as visiting there when I don't have custody. Is it a good bet it
will turn into permanent? Anything else I can do to help ensure that?

It is very good you got the temp orders and that it was 50/50. Document and put on a calendar all the days you have him and see him. Color code it, you one color, mom another color. Have it fit on one page (a few months), from now until next court date with totals on the bottom on how often you saw child. Get on the school list, go to any activities (take pictures when appropriate to do so- as a keep sake and proof for courts).

If it is going fine, and can continue through school with hours then ...should be okay. Great job so far :)
