Title: abandonment of child my ex girlfriend left the state an left our daughter

i got my daughter on friday like i always do , but on sunday when i went to take my daughter back i came to found out her mother left the state. how do i wait till i file for sole custody since her mother abandoned her ? PLEASE help a loving caring father

On Monday you file an emergency petition for sole custody based on the fact that the mother abandoned her.

This might be trickier than that. If he has proof that the mother says she's leaving the state, that might work (however, don't count on gf's mother testifying against her daughter). What evidence does he have?

If he doesn't have any evidence, he may have to file for an ex parte hearing and explain to the judge that he went to bring the child back and the mother wasn't there, blah, blah, blah.

I think he's going to need an attorney to help.
