I'm the NCP and was ordered to provide Health care insurance for my daughter. So now who pays for the deductible and the remaining bill after the insurance co pays their portion?
You'd have to provide the exact wording for anyone to be sure.
If it simply says that you have to provide insurance, then I would assume that whoever the child is with at the time of the illness would pay the balance, but I don't know.
In addition to your court order, take a look at your states law/code.
Some have been changed in the recent years to include verbage that might say something like "The CP has to pay the first $250, and the uncovered expenses are split according to income ratios." Now realize that "$250" might be lower or higher, and "income rations" might also read "shared".
And hopefully then you'll have your answer.
If neither say anything, then I say the NCP owes nothing. And if CP argues, then you might have to get this subject clarified by the court.
