bf was granted full custody 1 1/2 months ago but we are still waiting for them to agree on visitations. she and her attny keep putting us off. Until there is an agreement, or court orders a schedule...things will remain the same. Child still resides with mother, and father only gets mon, tues and thursdays. Judge did not state anything should change in the meantime. but she is bieng even more outrageous than ever, she denies telephone contact when he is with her. wont take him to baseball practices if child is with her, has basically stopped helping him with homework.projects. We have no legal orders yet, I only found the court minutes that says "Father granted full custody". Is there anything we can do to speed this transition up?
We are in Hawaii. Thanks for any input!!!
Light a fire under your atty.'s backside, tell him he works for YOU, and that if he doesn't resolve this matter QUICKLY, you will inquire with the state bar assoc.
wait a cotton pickin fricken fracken minute here.
Tell that bonehead cheeseball attorney of his to set a status conference. In that, his bonehead cheesseball attorney can let the Judge know that they're stalling, refusing to come up with some form of "agreement" and you'd like to Judge to slam dunk her with a real quick decision about parental time. (and the child returning home with dad) At the status conference, you can also request a Guardian Ad Litem, who will be a lawyer for the little person.
I had quite a few of those status conferences after monster got out of jail.
Think about it. There's no incentive for her to agree because BF was granted full custody.
You said it yourself, until there is an agreement, nothing changes. And therefore, BF doesn't have custody.
I also bet that CS to her continues too!
In California, the Minutes of the court may be used to excercise the custody transfer prior to completion of the formal orders. Unless the judge stated specifically that custody transfer did not happen until an agreement on visitation was made. Check with your attorney to be sure....

Well of course she won't...not on her own accord thats for sure...but as far as cs...that stopped when we walked out of court...she was pro-rated the 4 days in NOvember. She is just prolonging the inevitable.
Thanks TM...we will check withthe attny.
