Title: what counts as a caontact
Post by: delaware on Feb 29, 2008, 05:20:04 PM
Went to mediator this week and NCP is allowed to have supervised visits. NCP had 5 days to CALL to set it up. NCP sent a text message on the 5th day. Does this count as a call? NCP hasnt seen the children in 1 year.

Yes I would count that as contact by NCP -- because they can prove that it was sent by letting a judge look at the phone.

Did the message contain enough information to "set it up?"

You're in mediation......keep your thoughts focused on the goal of taking care of the children.

What's agreed to in mediation isn't law or court ordered, so hang in there.

So my husband didnt "text" her back. Its been 3 week and nj has made no other attempt to see her kids. I dont think it was her that sent it anyway her bf is an even bigger nj. So now my husband is waiting for court date. What are his chance of getting sole custody? she hasnt seen or tried to contact s11 or d9 for over 1 year.not even a xmas or bday card. Appartenly doesnt really want to see them.
