Hi,
When my ex and I divorced I let her keep the house provided she refinance when our youngest daughter graduated high school. The language on the decree specifically states that she will refinance or list the house for sale within 30 days of our daughter's high school graduation.
Surprise to me, our daughter didn't graduate. She will be 19 in November. My ex is now saying that she will not refinance until our daughter graduates from high school, which may never happen. She thinks she can keep the house indefinitely with my loan until that happens, even if our daughter is 35 when she finally finishes adult ed. Can she do this? I was under the impression that when my daughter turns 19, my ex has got to fulfill her end of the decree and refinance or sell, regardless of whether or not my daughter has graduated. Thanks in advance for any help.
