Title: Question regarding disputed medical costs
Post by: momof2 on Jan 07, 2005, 12:15:35 PM
I'm curious to hear others stories of how the courts have handled cases when one parent disputes the need for certain medical and/or dental expenses and refuses to pay their court ordere amounts.  I know that there are many times when an NCP feels that the CP either did not allow them to participate in the decision making process (when joint legal custody exists), or when the CP makes excessive trips to the doctor that the NCP feels are not necessary, and situations when the CP decides to get orthodontic work and the NCP feels it is not necessary and doesn't feel they should pay their court ordered amounts.

I'm wondering how court rulings have gone in these situations, and whether the judge decided the medical/dental procedures were necessary.  Also curious how situations have been handled by a court when the CP did not allow the NCP a part in the decision making when they share joint legal custody.

I've seen it go every which way over the years.

Braces, both ways.

Excessive medical trips, both ways.

Disagreements with a doctor's diagnosis, both ways.

So I say that it's up to the judge in the end.  There is no hard fast rule.
