Hope you've been well. I know you're a very busy person so I'll keep this as brief as possible. Here's the background: Hubby filed a motion for emeregency custody back in august 2003. This motion was heard sept 22nd 2003 and he lost. The next motions that were filed were done so on Dec. 20th and they were a motion for continuance based on the need for a psychological eval of sd because of some statements that she made regarding threats bm had made to her. The second motion was the actual motion for the psych eval with a request for hearing. we recently received a notice of hearing set for the 3rd of March to hear the emergency motion for temp custody again. We're confused because this was already heard. Soooo,

1) Would what was claimed in the motion for continuance and the motion for psych eval be reason for the court to reset the emergency motion for temp custody?

2) Would the court set hearing on their own motion if indeed this is their own motion?

3) Any other ideas as to why they'd want to hear this again when it was already heard before?

It may just be an oversight. Call the court clerk and discuss.
