Title: Do I need a court order?

My custody order states, that as an NCP, I can have my children on Wednesdays 6p-8p. The Wednesday parenting has been changed to Thursday by the TX legislature in September last year.

Can I pick up my sons on Thursdays, or do I need a judge to change what was in the prior order?

Ok, this IS one I know.

Pre-existing orders to the Sept 1 2003 change in the law,, continue as is. That law only effects orders in place AFTER that date. The same with the new inclusion to peace officers,, it only effects orders put in place AFTER Sept. 1, 2003.

Now,, IF you go back to court and get a modification to your existing orders, and they revamp the time,, THEN you will see the Notice to Peace Officers and the new visitation schedule.

If your order contains the actual text of the TX standard parenting plan, then that text remains in force regardless of changes by the legislature.

If your order only refers to the TX standard parenting plan as the controlling schedule, then any change(s) would automatically be incorporated into your order on the date that those changes become law.

You haven't provided enough facts to actually answer your question.
