Title: mediation
Post by: mom4good on Apr 01, 2004, 08:53:34 AM
We were spposed to have court this week when BM called the day before and asked to "settle". Our atty will set up mediation w/in the next few weeks. We were taking Bm/NCP to court for refusing to rt the child and basicly being nuts. She was and is pro se.
1. What occurs at mediation?
2. Does our atty go or just us and the mediator?

Mediation is a non-binding conference with the parents and a neutral "mediator" who attempts to help the parties negotiate a settlement of whatever issues are in dispute between them.

In some States (e.g., CA) mediation is mandatory prior to a court hearing, and attorneys are not permitted to attend. If this is a voluntary mediation, then whether you or the other parent bring an attorney with you or not is also voluntary.
