Title: Visitation blunder in progress

Hi,

   My husband and I are moving to Arkansas in a few months.  He has two children (9 and 7) from the previous marriage.  We would love to have the children to live with us all summer long, the BM thinks two weekends is enough.  Is it?? NO!
   My husband was planning to move to Florida after the divorce (5 yrs ago), and it was written in the decree "When defendant resides in Florida, he shall have the following parenting time......... 'and summer vacation from the second Monday after school is out to two weeks before school begins again in the Fall."
  Well, he never moved to Florida, and now we are moving to Arkansas.  She the BM will fight us, and her mother came to our house telling us that she will go bankrupt to get her the best lawyer.  We want to know, does she have a leg to stand on? Especially is there was an order already in place, just in a diff. state?

I'd say that you have a pretty strong argument that the mere fact that the location is different, doesn't change the substance of the judgment.

Now, if you were moving to Cuba or Iraq or China, that would be a different story. I don't think that AR is quite that bad...at least not yet!

Kidding, of course.

   Thank you very much!!!  We were thinking the same thing, and why would she allow it then, instead of now?? They are older now............  it makes no sense!!

   She is worried about them having homesickness........ how?? There is so much to see and do (surprisingly ; ) ).
