Dear Socrateaser, sorry to jump around with another question; but I am curious about subpeona---ing employment records for my C.S. hearing. My questions are, if you will indulge : Can a private individual subpeona records? Where can I go to initiate the process, if so? Also: Do you have a ballpark $ amount for the fee of subpeona---ing records?

Go to the court clerk and request a subpoena duces tecum in blank. If you are going to subpoena more than one record custodian, then ask for more subpoenas.

Don't know how much the subpoena in blank is, but it's probably less than $5.00. The person/entitly/company/agency being subpoenaed can make a reasonable charge for a records search in some circumstances, in others they can't. There are also witness fees, based upon mileage. there's loads of rules to follow. if you're not up on it all, you are better off hiring an attorney to issue the subpoenas so you get it right. probably could get it done for $100.
Actually, I filled out and filed and had a friend deliver all my own subpeona's.
It was a 10 $$ fee for the subpeona itself , and a 10$$ witness fee. hehehe,, kinda funny in a way,, I used subpeonas FIRST just for the documents,, read thru them,, and if it was information that was useful, I would then do another subpeona and pay a witness fee for the custodian of records.
