Title: PA Medical Question

Mother pays first 250.00 every year, then there after 60/40 split.  

Questions:

1.)  Do you pay for the medical when the Mother pays the bill and gives it to you, or do you pay from the date of service.  Example, giving us bills for 2002 from Nov and Dec, saying she paid them in 2003, so we have to give her the 60%.  

2.)  Two bills we got for Nov of 2003, last week, we paid our 60%, now she want's to use those bills to go towards her first 2004 250.00.  Again what do we go by when paying?  Do we just keep it as the year and the date of service?  or if the bill is from November of 2002 and she pays it in Aug of 2003, do we have to pay it as a 2003 medical bill.

If this is the text of your court order, it's written pretty lame. But, based on the facts you're providing, I'd say that the mother's responsibility is for the first $250 incurred during every year. So, for example, if $750 was incurred in 2003, and $125 in 2004, and you were presented with the bill in 2004 for all of the services incurred/rendered, then you would owe ($750 - $250) X .6 = $300 for 2003 and nothing for 2004.

BZZZ! You're putting facts into the questions. Anyway, my answer to #1 covers everytyhing.

Don't say when when we have to pay like service date or when she pays the bills.  You are awesome, Calling attorney now to get something to her attorney for an agreement.
