Title: Can I take a picture?

State of Florida

Trying to figure out if bio mom can forbid us to take her photograph, and forbid private investigator.  She sent us a letter stating that she does not give her permission to have her image/voice photographed, taped, duplicated or recorded in any manner known to man or conceived of in the the future by bio dad or his agent.

1.  Can I take anyone's picture without their permission so long as i dont publicize the picture or sell it?

If the subject of the picture is easily visible with the naked eye from a public place, and as long as you do not use the photo for a commercial purpose.
