Background:
This is for my brother-in-law.
Paternity test done, revealed to be father.
Going Monday morning to file to have name put on birth certificate.
Called mother of child, to talk about everything, from vissitation to changing child's last name to fathers.
Questions:
1. Can the father have the child's name changed to his? If mother of child says no, how do you go about that?
2. Since the paternity test came through Child support recovery, not through a court order, father wants to petition the courts for custody rights and visitation, would that be along the same format of a petition for modification? Would the way its written up, be about the same?

The only way to achieve what you are after is for the mother to consent to the name change...otherwise, No.

Basically, yes, except that you are "establishing" custody/visitation rights, rather than "modifying" them.
