Title: Custody Evaluation

Is it unethical for a custody evaluator to call one of the party's, prior to the release of his recommendation, to tell that party that he (the evaluator) will be recommending that party to the court for custody of the children?

Not by itself, but it could be used as evidence to suggest that the evaluator has some bias in favor of the other parent that is not simply the product of the evaluation.

You'll have to put the evaluator on the stand and ask why he would give either parent advance information on the results.
