Title: Custody Modification

Hi Soc! Child custody was established in WA state 2003. My husband and I won custody of my SS. We were living in MT at the time of the custody agreement. SS has been living in MT since 6/03. We have sole custody and she has visitation 2 times a month. The threat of the mother trying to take us back court to attempt to get custody of SS is always an issue.

Questions:

1. Since SS has been a Montana resident since 2003 wouldnt' mother have to fight for custody here in Montana since he is now a MT resident?

2. Or would she be able to seek a modification in WA since that is were the custody order was established?

WA court must first relinquish jurisdiction. It probably would, but ya never know.
