My daughter's mother basically is mad at me and has been given a free attorney by the state of Texas, because she is saying that Isadora is not mine she has found her ex and is getting a paternity test done they want to prove that she is not mine and don't want me to ever see the baby again. But until I moved out she never even lifted a finger to help take care of the baby. Our daughter was just a trophy for her to show off for all her friends. I want to know what are my legal rights if I'm not the father. I'm on the birth certificate and as far as I'm concerned I still want custody of my little girl.
The answer will depend on you state. Some states have a Statute of limitations on when you can no longer seek to disclaim paternity. If that does not apply in your case, if you have raised the child., you may still have standing to assert parental rights.
