Title: Jurisdiction ? here too!
Post by: kitten on Mar 15, 2005, 07:17:00 PM
BM moved to AK from Stanislaus county Ca in Jan.   SO no longer lives in Stanislaus county.  SO wants to fire attorney in Stanislaus and possibly hire attorney in Sacramento county (one county over) where he lives now.  It costs lots of $ to have Sac attorney travel to another county.

1.  Can he change jurisdiction just by filing for it?  Or does ex have to have some say in it?

You must file a motion for a change of venue in Stanislaus county. If no party lives in Stanislaus, the court will grant the change to Sacramento, but, the other parent is entitled to notice and opportunity to appear and be heard on the motion.
