Title: Private school
Post by: Dr.Stepmom on Apr 01, 2005, 08:33:11 AM
If custodial parent has full legal custody and shared physical custody (80:20 split) can the court make non-custodial parent pay for (any or part of) private schooling for child?

Child is 5 and has not yet entered school but noncustodial parent currently pays half of daycare costs.

If the parents agreed to both pay for private school, then yes.

If the child has special needs that cannot be accomodated by a public school then yes.

Otherwise, no. The noncustodial parent's obligation is to pay child support. After that, it's up to the custodial parent to decide how to spend the money.
