Title: Question about the Texas Domicile Restriction
Post by: futureuselesseater on Sep 23, 2005, 10:32:07 AM
I am looking for the laws on this and can't find it anywhere.

Do you have any knowledge of how it works?

Like for instance can a person request the court that the CP made to live in a county or surrounding counties when the NCP lives over 2 and a half hours away?

Thanks

A court will not order the CP to not relocate the child from a jurisdiction in which the NCP doesn't live. The purpose of this sort of restriction is to maintain the status quo in conjunction with a shared parenting arrangement. If you're two hours away, then there's no real shared parenting and the court will not make the sort of order that you are looking to achieve. You may be able to get the other parent to agree to this, (I doubt it, but anything's possible), however, forcing the issue is just not going to happen.
