Title: passport for a kid?

what can you do when a parent has a passport for the child (US passport) yet won't give it to you to use?

Divorce decret doesn't have any limitations on out of state, ...

is it possible to obtain a copy of the pasport so each parents have one for the same kid ?

The way I understand the United States Passport system, is ONLY at SOLE PHYSICAL/CUSTODIAL parent can obtain one without the other parents permission.

Does your ex have sole custody?


If you have joint custody then the other parent has to SIGN a form the US provides and with children under 16 I think it's only good for 3 years, might be 5 years haven't checked that out in a while.

she has sole physical
5 years for kids

but that's not the point, we already ordered the passport and we have it.
Just she has it and won't give it to me to travel with kid

the only answer.  You have to demand that she give you the passport, and she has to explain why she won't.  Bring copies of your mortgage/rental agreements, etc. to prove that you aren't a flight risk, which of course she will claim.
