Title: How to protect your self against false allications?
Post by: JOE BLOW77 on Jun 08, 2007, 12:10:27 PM
I am concerned that my ex will falsely accuse me of something.  What type of evidence would she need to do so?  Is it generally based off of her accusation and  Iam guilty until proven innocent?  If my previous experience is any indication then it would seem that if she says something it is considered fact until I disprove it.

She doesn't need any evidence to accuse you of anything.  There's nothing you can do unless she does accuse you of something.  If that happens, get a good atty immediately.

That's not true.

She can accuse you of anything without any evidence. However, in order for her to win, she has to prove her claims. Family court is just like civil or criminal court - you are innocent until proven guilty (although the standards of evidence vary).

Keep in mind that most family court judges have heard it all before - everything from child abuse to drug abuse claims. I would imagine it's pretty hard to shock a family court judge.
