Title: Can this be done?
Post by: Detter D on May 26, 2004, 11:22:24 AM
My final divorce was April.

House was ordered to  be sold...I am in the house
Am able to stay in the house until it is sold...court order

My ex has put a motion in to the courts that I am in contempt
because I am not aggressively promoting the sale of the house.

This is absolutely not true...4 Open Houses since April
1 offer refused by my ex
                                        numerous individual home seekers

1.  Will she be able to get this contempt and kick me out of the house
and her move in?

Not nearly enough facts. To find you in contempt, she must prove that you are willfully failing to adhere to the order. Make sure that your home is placed in the local multiple listing service, that you are keeping a record of the names and contact info of those who inquire about your property, and that your price for the home is approximately the same per square foot as the other homes listed in your area. That should be sufficient to show reasonable efforts to market the property.
