I am noncustodial mom, every other weekend, with mid week visitation with my 13 year old daughter.

Her father has moved out of state, and is residing almost 5 hours from her residence. He has left her with her stepmother. I live less than an hour away in another state as well.

Court order states that Custodial parent must give 30 day notice if he moves.  If the move is contested, child can't be removed from state.
I am contesting, filing a motion for a change of custody since he wants my daughter to be allowed to live her stepmother.

I don't agree with this, and since August of 2006, she has been living with her stepmother and half siblings without her father present. She visits me every other weekend, and him every other weekend.  We both reside in different states than stepmother.

At this point, she's not living with EITHER parent! He claims that this arrangement is best since her half siblings will be staying with stepmom and he doesn't want to split the kids up. I am ok with not splitting up the children, but I believe that he should take full custody of all the children if he wants to keep them together.

My personal desire is to have my daughter back with me, but in the interest of her own welfare, just her having a parent is the most important thing to me.  She resides in Illinois.  I am in Missouri, and father is in Indiana.  My lawyer has sent papers to the court for modification of custody, but his lawyer keeps delaying by filing motions to dismiss.

What, if any, chance is there of step-mother being allowed to have custody of my daughter?

Nope, sure doesn't.  Nowhere in there says i can't take kiddo out of state.

Take an interest in your future.  You'll be spending a great deal of time there.

Hey there, new poster, long time browser.

Quick question:

I am NCP.  In my parenting plan, it states "weekend visitation when in vicinity of child's residence with 48 hour prior notice"

Parenting plan was drawn up in tennessee, and both BF and myself have moved across the country several times due to the fact he was in the marines.

We now live 27 miles apart, each in an adjoining county.  I am in Arkansas, he's  in Missouri.  Even though "vicinity" is not spelled out in distance, can BF refuse visitation to me due to the fact that i'm crossing state lines with kiddo?

Any thoughts?

I actually posted to Socrateaser after reading other messages on the board.  We found out Aug 2006 this would happen, we filed Sep 2006.  Due to the continual "Motions to dismiss" we are still waiting on a hearing.
Thanks for a response.  I'll ask my lawyer about an exparte hearing today.

Any ideas on how to speed up court to get my daughter back with a parent.  I don't want kidnapping charges filed on me.

I am NCP BM.  For several years, after BF moved back in the vicinity of my family, I relocated to be near my child.  BF and current wife are "seperating" and BF is moving out of state to an adjoining state approx 6 hrs away.  He is moving alone.  I've never missed a visitation nor child support payment.

My kid wants to live with stepmom and three half siblings rather than change schools.  I'm 30 miles away in another state.  Kid doesn't want to live with father, nor mother, wants to stay at current residence.  I really want custody of my child, however at this point, I just want a biological parent to parent my child.  Do I have a chance at losing my kiddo to a stepmother because they want to live with their sisters and brother?

I am more than willing to maintain liberal visitation to the siblings and stepmother on weekends and holidays to be shared with BF.  I would never deny my child love from anyone, regardless of my own issues with the current arrangement.
