Thanks for the information.  That may be the only way that I can go.  I recently found out from an attorney in Texas  without proving the mother to be physically abusive, a drug addict, and or alcoholic there is almost no way for me to get custody.

Recently it was brought to my attention that my 11 year olds mother has been mentally abusing him for several years now and the family has been keeping it from me.   I have been told several different things from family members about what has been going on.  
The road block that I am running into is that she is trying to get him diagnosed as being bi-polar.  My concern with that is that when he turns 12 the court may dismiss his opinion.  I wanted some guidance as to what to do... oh yeah by the way I live out of state and the courts will be in Texas.  Which when it comes to dad's right in Texas, you might as well grab the carrot yourself.  

I have an 11 year old son in Texas. I live in Michigan. I have recently come to find out that the mother has basically been mentally abusing him for years.
1. What is my best option to try and obtain custody?
2. Will the court take into consideration his voice when he turns 12?
3. Will this have to go to trial?
4. Legally do I have a leg to stand on?

I tried following the instructions but struggled with the 5 days?
