Thanks for the advise.  I will check with the school.

I will ask for the day care to be billed directly so I pay directly, That way I am sure Child is in Daycare.

I am in the State of Oregon and I think they factor in non joint children because it is in the Calculator on the State website.

Hello Socrateaser,

My State is Oregon:

I have a child support hearing in two weeks.  I asked for one because I believe the amount is just too high. I will be getting less than $300 a month net if this amount is entered.

1) BM claims pays $900 for Day care when Amount was based her not working.  The kids also attend fulltime school.
2) I keep them every other weekend but BM refuses to sign a parenting plan that I put in place so I am not sure this will be considered.
3) I have another son that lives with me that was not accounted for because they said in their systems I don't take care of him.  which is not true
4) Amount is based on gross income when my net income will not even cover the amount they are trying to order.  This is bacause of Health Care costs, 401K and High Tax rate(Single) and Garnishment(Judgement order).

I need help and advises and what to present at the hearing that will help my cause.  

-Should I have the mum of the other child be present at the hearing?
-Will they consider how much I pay in child care for my other child?
-How can I force her to proof how much she is paying for child care?
-Do I need to have my lawyer present at the hearing?
-Any evidence that you think will help me?

I have twins and they live with their mum. There is no Custody Order or Parenting Time order in place.

I have been keeping the kids on a regular basis every other weekend and she has been letting me keep them. Well we got in a fight and she refused me not seeing the kids and there was nothing I could do.

Also she asked the state to modify the child support that I was paying. She thinks that I make more money and I do.

Well DCS is saying that they will not give me credit based on the fact that there is no parenting time agreement or a jude order. She refuses to sign one because it will mean less money.

I am basically done doing everything under the radar and will like to file for parenting time. I wish not to fight for custody as I know that is not likely. I just want to pay my fair share of support and also prevent her from refusing to let me take the kids.

She is also working but will not let me know where she works and DCS is not finding out how much she makes.

1) I really dont have the money to get an Attoney and wanted to file a case by my self using my state's legal help for family law. Since I am not asking for custody do you think I have a good chance of getting a parenting plan in place and a modification of the Child Support? My state is Oregon.

2) Should I just go for parenting time first and then once I get that go for modification of Child Support Amount?

3) How do I get the State to take into account how much she is making?  I don't know myself but I am thinking maybe there is a form I can fill out to so that the state an initiate some form of fact finding mission.

Thanks for the advise.  It is definately some good insight.  I talk to their teachers at school and see if they have any concerns.  

As far filing a report I understand I need to be sure before taking such and action.  It will definetely make even more hostile towards me,  but at this point it might be worth it if I know for a fact that the house is unfit.  

I must admit it is a delicate situation. Some one sugested a private investigator for proof of neglet.  What do you think?

Hello Socrateaser,

I have 6yr old twins that live with their mum.  Parternity was established by the state in 2004 right before I graduated from college.  

I ended up oweing over $10000 in back childsupport which I am making monthly installments including regular child support payments every month.  I also provide Health insurance for the kids as a requirement by CS Enforment.

Since graduation and getting a good job I have been having them come over and spend every other weekend with me.  There have been weekends the did not come over because I was working out of town.

My problem is that I want to be much more involved in their lives.  The environment in which they live is dirty and to the point where I think is unsafe.  

The boy has also been having problems at school and this is mainly because there is no structure at their mums house and she is not stable.  She has left the kids in the care of her 13yr old several times over night even though I don't think he is mature to take care of 6yr olds. The Girl has had a skin desease for almost 11/2yrs now that is not going away.  They don't take showers often and are always dirty when they come over. They hardly brush their teeth.

Bottom line is I need to start spending more time with them but I don't have any custody. My question is how do I go forward from here with the ultimate goal or having half custody or if possible full custody.  They will be better off with me.

She just quit working and still does not keep her evironment clean.  One time she even failed to take the kids to school because she was too lazy to wake up in the morning.  I really don't care about the child support and will not mind paying her as long as I get to keep the kids in my home so I can have control over their wellbeing.

Any advice will be greatly appreciated

I found out 2 years ago that I am the father to twins.  I took the parternity test through the state and I am paying child support now.  I am also paying on back child support.  The kids do not have my last name and I would like them to since I am the father.  I don't mind them having her name in there too but I would like to add my last name.  Also right now I keep them every other weekend but I don't think the state is aware of that.  how do I bring visiblity to what I am doing so that I am legally recorgnized as a responsible father.  That way if the need be I can prove it.  

The Mother allows me to take them when I want to.  But I am from a different country and in the future I will like to get them intouch with that culture by visiting.  I don't think I can do that as she will not agree.

Any Advise will be helpful.
