I have a question for any one who can answer. My daughter was recently taken out of the home by DHS for reported Child Abuse. I was notified by DHS out of state of the incident. I immediately flew down to see about my daughter. When I arrived, I was told by DHS that my child was placed with the moms friend (nearby) and that a saftety plan was in place.

The mother agreed that she applied more than necessary force to the child causing my daughters arm to bleed from possible belt buckle blows.

My daughter was then taken to counseling which they suggested that mother recieve psy counseling.

I filled for emergency custody and was granted. The child and I returned to my state of residence. I then after filled for sole cutody and the mother objected. She desires for us both to share joint custody with her maintaining physical custody after she finishes her anger management classes.

My question is does she have leverage to obtain physical custody in a few months after DHS "founded" child abuse?

Mother is presently on "supervised visitation" as per DHS.

DHS has since withdrawn their case immediately after my recieving temporary emergency custody.

Dear Socrateser,

I've been on the board since April of this year and have been very pleased with your advice as well as the other parents in the various forums.

I was granted temp cust back in May of 06 for founded physical abuse by custodial parent. My child and I were allowed to leave the state after school let out this year.

Next, the child was then arrested and charged with battery (beginning of school year)  in state in which we both reside.

The Juvenile court Judge releases child in my custody and places child on house arrest. Until next hearing, after which I placed the child in the following:

Family counseling

Anger mgmt

Community Service

At the next hearing, the judge felt that my wife and I were punished for the child's lashing out at school and wanted to see if the child would make passing grades and stay out of trouble. He knew that my wife and I took it upon ourselves to provide the child with the best defense in such a catastrophe.

The Judge held over his decision until the first report card in which he could possible dismiss the case or ask for jail time for the assault.

Well 2 weeks ago before hearing (Dec 20th), the child gets suspended for making "terroristic threats" to another student and will be permently expelled if physical violence happens again.

My wife and I had a psychological assessment done and received feedback from the teachers. Child has a "B" average, but cusses like a sailor and is sometimes unruly when given instructions by teachers.

Meanwhile, the other parent has taken all of the "anger management" classes and made a deal with social services in order to have "unsupervised" visits.

I had a "telephonic hearing" last week and Judge out of state wants me to pay for a plane ticket to send child to visit other parent.

My fear is that all of the work that I put in with child is going to go down the tubes after the visit. It seems like I'm the one paying a hefty price for having temp physical cust. Other parent has not paid me any support or help out on the child's legal fees for juvenile case. Not to mention, the courts snatched my income tax return "erroneously" for arrears that was already paid to the other parent.

Results from Psychological eval come back next week.

How could these findings help me? Child has documented history of fighting before I gained Temp custody.

Is it possible to get the judge to postpone visitation until juvenile matter is cleared up?

Would I be responsible for paying travels fee's if the case is kicked out of court?

Dear Socrateaser,

I've had temp emer custody of child for approximately 6 months. The Judge (Northwest) awarded me temp emer custody after mom beat child. The child came to live with my wife and I after custody change. The child is a good kid, she just has a serious anger problem. I've recently learned that the kid has had several fights and school suspensions before coming to live with me.

My kid has been in school since August and has already been expelled for hitting a teacher and student. The county agreed to send her to alernative school. She's been in the alternative school for 1 month and has been suspended for making terroristic threats to a student.

The BM claims that it's because I "took" the child. The child goes to anger management, counseling, and girl scouts and admits that she can't control her anger.

Question: will her anger problems cause me problems in the court?

Child has definately learned not how to control temper from mother. The child has not lived with me since 3 years old. The child in now 12.

What else can I do? Is homeschool an option for the courts?

Dad is cross eyed when trying to work with an angry child. I love my Kid endlessly and will do whatever it takes.

Dear Socrateaser,

I need your wisdom. I was granted temp emer. custody in Multco, Or a few months ago from Judge.

My child was taken out of a real abusive home and the other parent was ordered to seek anger management along with supervised custody.

A hearing was set for Nov in Multco to review the status of the child.

My child came to reside w. me in Atlanta and has been undergoing counseling for her behavioral issues.

Daughter was enrolled in school and everything was fine until daughter got into fight and was charged with 2 counts of battery, of both a student and teacher.

Child was taken into custody and released in my care, placed on house arrest, and ordered to a mental evaluation.

I'm totally hit with a right cross, because I just spent over 3 grand to tie things together in PDX.

Will this recent incident hinder my chances of recieving full-custody. It is evident that the child has some "real" anger issues stemming from  previous abusive experiences.

Wow, I was in deep hesitation of allowing the mom to option of supervised visitation. I have to attend a hearing in the next few weeks in regards to visitation and will follow your advice.

I will also refrain from allowing phone calls as well. Until further notice of the courts.

Will the two visits cause me problems in court?

Dear Socrateser,

I've had my child in my custody for over 1.5 weeks. I was recently awarded Temp Emer Custody as mentioned in a previous post. The state and DHS ordered that the mothers parenting time be as agreed to by DHS.

DHS has since withdrawn from the situation and have advised me to administer visitation with the safety of the child in mind.

5 days after the hearing, I allowed for a supervised visit between the ex and child. I also allowed another "supervised visit the next day"

I was not there for the visit, and the mother began bashing me to the child. (Documented in journal and orally confessed)

The supervised mediator who DHS recommended was a friend of the ex's and she also began bashing (talking about past events of me and the ex) to the child.

My ex told the child the exact amount of arreage child support owed to the ex and showed the child court documentation.

As you know, the child came home with attitude and began parrotting the anger and words from the ex and family.

Is there anything that I can do to stop this foolishness from happening. Do I have to allow phone calls and or supervised visits with the same person who also advocates the foolishness?

I need guidance on the issue because this anger from the outside is beginning to stir desention in my home.

Thanks for the heads up. I see that this is a real 50/50 situation.

Like Vanbulo said, "let the chips fall where they may."

I'm not going to go into it with a "they must grant me custody attitude." I will keep an open mind and do the very best thing I can do as a father.

It's in the Lords hands and that's it.
