[5th amendment rights]

My questions are this.
1. Can CPS keep me away from my child just because there is a criminal case open even if I have not been charged with a crime.

2. I have been told they will take are child away from her mother if she cant keep her away from me and they will place her in adoption can they do this even when I have NOT BEEN CHARGED with anything.

3. CPS recommended to the Judge during the emergency protection order hearing that I should not have any parenting time with the child because of the investigation even tho I have not been charged with ANYTHING, did this act violate my 5^th amendments rights?

4. If CPS do try to take my parenting time away from me is that violating my 5^th amendment rights? Also can they even try to take my parenting rights way from me or keep me away from my kid when I have not been charged with anything.....

1) CPS can do almost anything they want, they have broad powers and often abuse them.

2) They may be able to, and we'd recommend hiring an attorney. I know you said you cannot afford one, but there are times when there is no practical alternative.

3)  5^th amendment rights (http://en.wikipedia.org/wiki/Fifth_Amendment_to_the_United_States_Constitution) deal with making statements that may tend to incriminate you. I don't see how they would apply to your situation. (??)

4)  See #3 above. I don't see how 5th amendment rights would apply to your situation.

The question is if I do move out do I hurt myself in a custody battle by doing so.  I have already told my wife the I want the  kids 50/50 if I do move out, even before we file.  I live in California.

In general you should seek to establish a 50/50 time share- the courts may very well look at her increased time compared to yours as an indication of who is the "primary caretaker". This can be a significant factor in how custody is viewed and decided by the court.
