Child Support Issues / RE: Questions for change?
Oct 01, 2008, 05:42:24 AM
Since my children's father has never paid a dime on his order, and I know there are a gazillion parents out there like me, I would like to see measures for work enforcement.
if a parent owes child support, does not pay, is under employed or refuses to be employed, the judge should order parents into work programs like they do in Michigan.
I don't care if its picking up trash on the highway, they should be forced to do some type of work by a court order until they find a job on their own.

Child Support Issues / RE: Hope and pray.....

I hope you are right.

He still has not paid a dime. CSE told me the next step is contempt, yet there is no court date set for that.
By the time a hearing is set for contempt is will be late November or December, and I know he won't pay a dime until he is threatened with jail.
How can someone not care about their children? He has not seen, ( or corresponded in any way) his kids in almost 8 years.

Child Support Issues / RE: Opinions please...

Do you have any idea what she makes?

What state are you in?

In some states like NJ/ NY child support does not end until 21.

Also, in your last order was daycare included in the calculations. If so, you could see a downward modification as this would not be part of a calculation anymore.

Child Support Issues / called CSE
Aug 08, 2008, 11:37:47 AM
I called CSE.

The next thing that is going to be done is a motion to show cause for contempt. YAYAYAYAYAYAY!!! So I guess that means a court date  in October.

Hence, they will will have to submit a purge guideline. Honestly, I don't know if he will pay even with that threat. He may just end up in jail.....

Your order for child support will be dependent on the state that you live.
Have you legally acknowledged paternity? Did you sign the AOP at birth? Are you on your sons birth certificate?
If not, this will be pursued first in court. Since your children were born outside of wedlock, it is best to have paternity acknowledged through the courts by a DNA test.
Custody: Most likely the courts will direct you to mediate this with the mother. Playing nice now and later is the best thing you can do so this progresses smoothly.
Ocean is right. keep track of the time your are spending with your children. Legally until there is a decree for custody from the courts you do not have any rights to visitation. Hence is may be best for you to be proactive and go to court first to establish custody, paternity, if this has not been done already, and child support.
This protects you, the children, and the mom. CA usually tend to decree custody at 50/50.

Child support: CA child support is not a standard percentage. For an estimate of what you would pay got to //www.allaw.com.
Again you should be proactive and file in order to protect yourself

Child Support Issues / thanks for your replies

I call and speak to CSE a couple times a month. They said they have to follow a process and doing QADROS are very difficult.
He has put property and accounts in other people's names- ie new wife.
I don't know how he is getting around.

What I am wondering is:

If I hired an attorney to go after hidden assets would it be worth it. Could an attorney go after (bank accounts) etc that he has put in his wife's name. CSE seemed reluctant to do this........
If I hired an attorney would they really have a chance at getting after these accounts??????

anyone in NV or familiar with NV CSE, I would love to hear from you...

thanks everyone for your responses

Hi there!
i appreciate any advice that can be offered in regards to child supprt in Nevada.

It has been over a year since child support was ordered and I have yet to see any support.
Assigned arrears are over 12K.

Several months ago his drivers license was taken.

What comes next????

If a motion to show cause is pursued, what percent of arrears are required for a purge?

Does the DCSE ever go after bank accounts, property, IRAs 401Ks via a QADRO?

He does have funds, and a business, but just refuses to pay?

Anyone with experience, especially in Nevada, is encouraged to reply.
