I'm sorry I meant that he is in jail for six months as his sentence. He had to pay $12000 or spend six months. He has child support payments through the court for 2 of his 4 children.

My husband is in jail for six months for two of his four children. His youngest daughter whose mother died in april 2007 lived with her grandmother with whom her mother lived with prior to her passing.

Right now I was under the impression that in SC grandparents did not have superior rights and that a parents rights were superior. He will be released in December and has not been allowed to see much less talk to his daugher since May 2007.

The judge did not allow anyone in the hearing room unless the grandmother approved. Needless to say she made a lot of false allegations even that my husband had never been in his daughter's life. She even stated that his daughter would not recognize him if she brought her in the court room. She refused to bring her in though.

He went into court with pictures that he had taken with his daughter throughout the years along with phone records to show he had been regularly speaking with the daughter's mother prior to her passing.

Prior to her mother's passing, the daughter and father had a relationship. However, the grandmother has avoided his phone calls. He attempted to fight custody, but lost because the grandmother lied. She requested that none of his family remain in the room for the hearing. She moved to maryland even though the case was tried in SC. Will he be able to appeal to get a fair case.?

Does anyone have any advice?
