well my ex's father owns a pizza shop and convenience store/broasted chicken shop in the city and for the last 7 years, 5 of which i managed the pizza shop, the entire city police department which consists of over 100 officers, about half of which i know on a first name basis because of my time there, do not pay for anything anytime they are on duty.  I know he has gone out drinking with several of them after hours and even loans them money when they need it.  same thing goes with some local probation officers and a few of the local sheriff's deputies.  he also previously was involved in a business arrangement with one of the county judges and i believe the D.A. and several of his detectives.  his wife works for the county commissioners office and has numerous connections with them.  i think the state attorney general would be the best way to go.  he is also comitting other federal offenses where the businesses are concerned.

are you saying that someone with a problem that would normally call the police about can call the sheriff's department instead and have them respond?  I was under the assumption that the sheriff's department only handled warrants and such, please elaborate on getting them involved.  thank you father time!

to everyone out there feeling as desperate as I was.... don't give up!  I found out today that an attorney is willing to take my case pro bono... I found out today that most counties have a pro bono program and as long as you meet the financial eligibility requirements and have a good enough case someone will take it.  will keep you posted on my case

Let me first commend you on taking the higher ground.  I hear of so many parents who just don't do the right thing when it comes to their kids.  I understand that in a lot of cases the mother is the "best parent" but not always.  I myself am going through the same thing but my ex did take the kids and move.  the nice thing about pa is they gave her two days to have the kids back in this jurisdiction with proof of residency and enrolled in school or i would have gotten full custody.  she succeeded with the help of her father.  her dad signed a bs lease and the kids slept on the floor of her friends house for two weeks until their apartment was "ready". Keep doing what you are doing and fight for your kids.  They will thank you in the end.

not sure of all the facts but it seems to me if you were granted emergency temp custody until a hearing and no visitation is stipulated in that order, than none should be granted.  who is telling you to give a visit and are they aware of temp order?

we only live a mile and a half apart and during my week i provide all transportation.  we agreed while we were married that we would never send our kids to center city school and when she moved into the city i offered to provide transportation for the kids to go to my school on her weeks and she refused due to contol issues.

I am in Pa. and my ex has been denying me visitation despite a court order.  The school involved has all pertinent custody paperwork.  As of the start of school she no longer had the power to keep me from seeing them.  This past friday I went to pick them up at the end of the day.

She instructed the school to call her if I show up and they did.  She showed up with her boyfriend, father and two other guys that work for him.  The principal feared for my safety so he  had me taken to remote office upstairs.

Police showed up whom are personal friends with her father and told me I wasn't taking the kids despite it being my week of custody.  I left and filed for a pfa due to the hostility and safety concerns.  School officials agreed to type a report of the incident for me to use in court.   

I called the school to request the letter and was told I have to have my attorney send a request letter instructing what should be written in their letter.  I don't want fantasy, just the facts of what happened and why principal handled the situation that way.   

1.  How do I formally request letter from school about the incident when I am representing myself pro se?

2.  Should I forego the letter and have the principal subpoena'd ?

I hope I haven't forgotten any information.  Current custody order states 50/50 week on and week off.  She filed for modification hearing after child support was lowered.  I filed contempt of court order which will bring up at conciliation or new business I am not sure.  I am going to ask for make up time of 3 extra overnights per month, which in turn will give me majority custody.  I haven't seen my kids 9 out of the last 18 months due to her contempt.

3.  Is make up time something usually granted ?

4.  Is my request of 3 extra overnights per month unrealistic?

yes, enough is enough.

filed a motion for contempt today, pro se, it was free i didn't know that

also yesterday i went and filed for a pfa and was denied temp pfa but have a hearing for a permanent one on 9/14

2nd round of conciliation is coming soon and i will bring up the contempt charges and that i will not drop them this time.  school told me that me and ex have to keep track of who's week of custody it is. 

I am hoping that with the letter from the principal and the entire office staff as witnesses to friday's events, i will be granted my pfa and it will be enough to show the judge her intentions, i am not sure though as we are going in front of the same judge for the pfa hearing that we went in front of before when he made me drop the contempt charges because he was in the "holiday spirit"

currently they are enrolled in the center city school district which i fought for and lost.  I wanted them in my suburban school district and offered to provide all transportation for her because she doesn't drive.  we both agreed while together we would never send them to that school but because that was the only place they could find a residence on such short notice, she sent them so i wouldn't gain majority custody, it is 50/50 with her having school district

I also live in york county Pa.  I have no information on a good attorney as I feel mine was innefective.  I can tell you a little about my story which may help.  About a year ago my ex and her boyfriend witheld our two children from me and moved to southern maryland.  It took me three months to find them and when she realized I found them she immediately came back to file for custody.  I could not file because I didn't have her location to serve her.  Shortly thereafter, at conciliation, she was ordered to return the children to me to start my visitation and was given 4 days to move back, obtain residence in york county and have the children enrolled in school or I would receive primary custody.  I will keep you posted on any other advice I have but I also know that the courts hold in high priority the marital home, if he keeps it, they will most likely want the children to stay there unless she can prove they are better off with her.  Tell him to file first, that will make a big difference as I have learned, especially for child support.  I don't think they are hard on fathers as much as who the defendant is.  Hope that helped a little.
