Illinois was sued over raising a support order without  going to court about 4 or 5 months ago. They were told that is was illegal since the Support services were not the ones who did the original order. They court made them pay back the money and was told to NEVER do this again. It was a huge deal in Champaign county IL where it happened. It even made the news.

I have asked for a modification several times and have been told the same thing "its in the mail." My ex thinks that she is the one that can make the modification so she can get more. I have told her time and time again unless I am there to agree they wont give it to her. Even a lawyer has told me and her that and yet she still insists on doing it.

i just went throuvh my divorce records and it states that I'm not liable for medical expenses since she only pays $7 a month for it. I asked about my part and i was told there was no need as long as the child is on it. Both lawyers agreed to it and the judge signed off on it. I guess since she has no job (and isnt even looking for one) and is getting state aid they are going to make me pay it. Ya me.

Looks like its time to get a lawyer and see what i can do to get all this settled
. I've fought the system so much I feel beat down and abused. Noncustodial parents seem to never get a break.

Just found out today that my child support order went from 700 a month to 880 a month for 1 child. This is the second time Child and Family Services of IL has raised it without a court order. Every time I call them to complain they say they will send out a income withholding order change paper and I never get one. I have also told them that they are charging daycare expenses as child support. I was under the impression that daycare expenses were separate from child support. That's what both of our lawyer told us in the divorce. I don't think I should have to pay daycare for a child that only spent 6 months in it in the first place and hasn't been in it since. Also Child Support services are making me pay for medical expenses when my child is on Illinois Kid Care which is free to his mother. They told me that she has medical bills for the child. I haven't seen any bills and I wonder how there are bills for FREE medical insurance. I guess I might as well pay the 880 a month so she can continue to sit at home and not do anything. How do I put a stop to this non-sense?

Sorry its been awhile since I have been on. Well just found out today that the termination IWO will not be honored because IL Child and Family services said that the paper I received was so that FL would terminate their support order against me for the same child since the order was originated in IL. I still don't understand how a legal document isn't legal. Guess I'll just work for the rest of my life.

Illinois and Florida refuse to honor it. They said it was sent to me in error and I still owe child support. Well I guess legal documents are not taken seriously anymore. I had my taxes taken from me again this year as well even after filing after the order termination. Seems non-custodial parents have no rights anymore.

Well I received my Income Withholding Order termination paper from Illinois but the Illinois refuses to reconize it. I have tried to call only to be told to call back later and have sent 2 emails only to be ignored. The States Attorneys office told me to send a copy of the paperwork to them so they can enforce it. Looks like Florida will NOT be able to pull jurisidiction on me now. Hope it all works out. And it was nice to find out that my ex was using her food stamps to buy food for her new bfs house instead of her own. Then she expected our children to go there and eat. My oldest refused and then didnt have food to eat. I am one pissed off father.

I have been in contact with both states now and they both are screaming jursidiction. I think its time to get a lawyer and let them have at it. I will not be filing my taxes until they get this straightened out. Last year FL took over $4,000 over my taxes and told me it was a gift and was not put on my back support. I wont go through that this year. Its bad enough I paid on a chiild that was 18 for over a year. I dont mind paying my back support but I dont feel I should have to pay for 2 states. See what happens.

I live in IL and my ex lives in FL. She moved there over 3 years ago and had to file for state assistance since I was only working part-time and she went from 15/hr to 8/hr. Now the state of FL is telling me that I owe them back support as well as IL. The original order was filed in IL and I was told that that's where the order stayes. Now FL is asking for the back support and took my taxes last year and didnt put it towards my back support. FL also told me that if I'm behind in support in IL that they will be adding that to their back support and I will have to pay that as well. According to the law that's double jeropody and that IS illeagal. I have been fighting with this for a year now and I just need to get this all taken care of. I just need to know who has juristiction and how I can resolve this.

In IL all you need is 6 weeks of back wages and make sure you do your finacial sheet that you can get from CS Services. They will also want any back tax papers. Since you are behind there is also interest being charged to you at 9% annually. The last thing you need to do is find out what percentage is being taken of your check each week. The maximum allowed is 50%. I just got done with a CS order case and found out that the courts and CS Services had it set up that over 100% of my check was to be withdrawaled each week. Since my checks where less then my CS they took 50% of my check and chared me with back support. The states attorney office in your county will help you with the modifcation as well if you need free legal help. That's who did mine. I hope this helps.
