Speaker BIO: Mindy Mitnick is an evaluator, therapist, and parenting consultant. She is one of the most renowned custody evaluators in the state of Minnesota. She has earned the complete respect of judges and lawyers statewide, and is frequently called upon as an expert in the field. She is well recognized for her ability to sort through the most complex cases. Mindy is a Licensed Psychologist. She received a Master of Education from Harvard University. She has spoke to national organizations.

Especially, register for the forums and scroll down to the county by county District Court Judges section where you can post your comments about a judge or an attorney. They're starting to pay attention to us and are scared, so let's keep after them!

Kitty C and I have posted alot of other info about Iowa's new joint physical care law on the Fathers Issues board here on SPARC as it is the most widely read. Here's a letter I rec'vd today from the Gov's office.

May 25, 2004

Dear *****:

    After much reflection and research as to what is best for Iowa children, I decided to sign House File 22, which establishes in Iowa law (Iowa Code Section 598.41, subsection 5) the presumption that children benefit when both parents remain positively involved in their lives after a divorce.

    This bill takes into consideration studies that have found that children tend to do better in school, feel better about themselves and remain more emotionally and physically healthy when both divorcing parents take a loving, nurturing role in their children's lives. Whether in divorced or intact families, children need a mother and a father. Each makes a substantial, though often differing but complementary contribution to the child's life.

    While the bill creates the presumption that joint physical care by both parents is to the benefit of the children, the bill does allow judges to deny requests for joint physical care if there are specific findings that joint physical care would not be in the best interests of a child. This would protect a child from a parent or home situation found to be physically or emotionally abusive or otherwise negligent or generally not in the best interest of a child.

    The bill also does not preclude divorcing parents from working out their own mutually agreeable, court approved parenting and living arrangements for their children. Every child in Iowa, whether in an intact or divorced family, is entitled whenever possible, to the love, the nurturing and the creative inspiration offered by two parents who share their responsibilities toward their children. House File 22 deserves a chance to succeed.

unanimously and one absent, thats right 49 YES and 0 NO. Your efforts
made this happen and all of you deserve credit for this victory. With
such a strong vote in favor of HF22 should place more pressure on the
Governor to sign. Two years ago he vetoed HF678 in addition there was
a party line vote in the Senate that helped weaken that bill. Today's
vote is proof to all of you that the Iowa legislators are listening
to you.

Our next and final step is to focus on Governor Vilsack. We need to
be polite and encouraging. Ask the Governor to sign the bill and tell
him in your words why this bill is important to you and your
children. Try to keep it short and sweet. Continue to write, e-mail,
and call the governor as often as you can. Now is the time to ask
your family and friends to help out. The Governor has one month to
consider his options so we can't let up. THIS IS A VICTORY FOR OUR
KIDS!

This bill would allow judges to presume joint phyisical care in the same manner as joint legal custody is currently decided.

Just looking for feedback, this seems like an excellent idea, a class action suit, against the states, in federal court for equal custody...  

They seem to have considerable support as someone in nearly every state has signed on to this, but being the natural skeptic I am at times, could this be too good to be true, or does it have the potential to be a dream come true?

The multi-state filing is scheduled for this coming Friday, Sept 17th and I jumped on the bandwagon and applied for and got appointed as my state's coordinator. (Ask and ye shall receive, eh? lol) Already I'm wondering if I'm in over my head or can somehow follow thru with this.

I've been told the only cost is a $150. filing fee, (which could be waived) the Indiana group is asking nothing, other than being the person to physically file the paperwork.  Since the Federal district courthouse is just a few minutes from my home, I figured why not... maybe it's just butterflies in my stomach, but I sure would appreciate some feedback from anyone here about this. Thanks!

On Saturday, April 21, 2007, we are holding our first ever Non-Custodial Parents Rally in Des Moines in observance of Parental Alienation Awareness Day, which is April 25th.

Guest speakers include Presidential candidate Dr. Mark Klein, Stephen Baskerville, PhD, the president of American Coalition for Fathers and Children (ACFC), Dick Woods of Fathers for Equal Rights, Pastor Ron Smith of Children Need Both Parents, Inc (Chicago, IL), among others.

The event is being held from noon until 3:00 p.m. at the Civic Center of Greater Des Moines, 227 Walnut St., Des Moines, Iowa, 50309-2104

The event is FREE but registration is required so we know how much food and drink to order.  Please register by filling out the form below.

I think his web-guy put the page together in a big hurry as the "send" button is tricky to find... Scroll slowly and horizontally after you complete the form. It's there, I sent mine.

If we can't get the program stopped at this late hour, we MUST persuade PBS to allow a rebuttal which is precisely what Ned Holstein, M.D., M.S. and founder of Boston based //www.fathersandfamilies.org is asking for our help with. Don't let PBS get by with unfair information!

On Thursday, PBS (Public Broadcasting System) stations around the country will air a one-hour documentary entitled "Breaking the Silence; Children's Stories." This film is an arrow aimed at the heart of the shared parenting movement. It says that those of us who want to share the custody of our children are wife beaters, and child abusers too. It gives no air time to opposing points of view.

We must respond.

Your mission is to help us generate heat on this taxpayer-supported network for abandoning balanced journalism and broadcasting blatant propaganda. You can do this by going to the link at the bottom of this email, which will take you to a website where you will have everything you need to respond: contact information for PBS executives, more details about the program, suggested letter, etc.

Responding to this show is extremely important. It is being picked up by radio stations, newspapers and other media outlets. We are demanding an opportunity to rebut.

A coalition of organizations around the country is working cooperatively to respond to this slander. We will generate a substantial response, but your participation is essential.

The program claims that in 75% of cases in which fathers seek either shared or sole custody of their children, they have a history of being batterers. The show also claims that two-thirds of the time mothers allege domestic violence, custody goes to the fathers anyway. The show further implies that almost all child abusers are fathers and that parental alienation is a ruse by batterers to win custody. These assertions are false.

Our demand is that PBS give us an opportunity to rebut these smears on the air.

NEW CAMPAIGN: All Out for California Shared Parenting Bill!

As many of you know, this evening we declared a new His Side listener campaign in support of AB 1307, the new California Shared Parenting bill.  AB 1307 will create a clear presumption that parents equally share in the custody of their children unless there is clear evidence that it would not be in the children's best interests. AB 1307 protects children's relationship with both parents by making it clear that parents come before the family law court with equal rights to and responsibilities for their children.
California family law has enormous impact on the family law of other states, many of which are currently considering shared parenting bills. A victory on AB 1307 would reverberate across the country, aiding in ways large or small every child of divorce.

Hearing from so many of you over the past several years, it would be hard to put into words the amount of pain and misery caused by our current family law system and its sole custody, win/lose orientation.  Now is your chance to help change the system.

Though every His Side listener campaign we've launched so far has been successful, this one won't be easy. AB 1307 faces a tough fight from misguided feminist groups and other powerful forces who have already begun to assemble to oppose us.

Please recall, however, the events of last summer when we mobilized over 2,000 people to defeat a bill which would have given custodial parents almost unlimited right to move children out of noncustodial parents' lives. On the morning of August 16, Dan Walters, perhaps California's leading Sacramento insider, proclaimed in newspaper columns across the state that we had no chance to win. That same morning we received word that the bill was being pulled and we had won.

The California Shared Parenting Alliance (CSPA) is spearheading the bill.

Things are finally under way in Illinois. Mike Burns from the Illinois Shared Parenting group has been actively engaged with Illinois legislators. We now have a bill ready to move out of the Illinois Judiciary Committee. We have to convince the committee to vote in favor of the bill then it will go before the Illinois House. Like Iowa, Illinois has the same organizations fighting to stop this bill. These are the organizations who make their bread and butter of off of broken homes. (evil lawyers!)

I'm asking all of you to write to each member of the Illinois Judiciary committee and ask them to vote yes to HB1431. Illinois members have helped the Iowa side, now it's time to return the favor. We need to show them we are for real. Information about the bill is below.

Always be polite and to the point. JPC will get more parents to the bargaining table and more children will benefit. WE NEED A YES VOTE!!!!!!!!!!

SYNOPSIS AS INTRODUCED, HB1431:

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that the court shall use a rebuttable presumption that joint legal and physical custody is in the best interest of the child. Provides that, whenever it appears that both parents are fit, but that joint legal and physical custody is not feasible and cannot be remedied by a Joint Parenting Agreement between the parents, the court shall use a rebuttable presumption that the best interests of the child will be served by granting legal and physical custody to the parent more disposed to encourage and permit frequent and continuing contact by the other parent with the child. Requires the court to justify any departure from the presumptions with detailed findings.

Here's what I wrote:
Dear neighbor, Greetings from Iowa,

Please vote yes for HB1431.  Don't hurt the children anymore. I've lived in Springfield, nearly lost a toe there when I was 4.

Children need both parents.... they do best with both parent's involvement. Their time, their enthusiasm. Time = money.

Sure, money helps, but it does not replace a parent's love, attention, care, devotion, skill sharing, the list goes on.

Please, Illinois legislators, do something positive for the upcoming generation. Allow them easier access to both parents.

Do not be the adults that said NO, you can't see your dad or your mom, grand or step parents for no sensible reason.

Don't cave into the feeble argument that some lawyers practice, that being feeding off of broken homes.

Show America and the world that you really care about children.  We'll be watching how you vote.
