I have a cousin who draws money from the social security system because NCP is some kind of disability for bipolar disorder.  I'm not exactly sure what the NCP gets in benefits, but the NCP did LIE about custody and was getting the child's benefits along with her own benefits.

Now money is direct deposted in CP's account for the child.  They had to fight for this about 2 months.  Also NCP had to PAY back all the money she drew for the child when she did not have custody.

Be sure you get an appointment with social security so you can have a face to face meeting.  Take your current court order showing you have custody, birth certificate, social security card, and anything else of importance.  There are a lot of forms to fill out.

Sounds like it depends on the state and how they want to count it.  In my cousin's case it is NOT part of the calculated C/S.  It is deducted from the NCP's portion of SSI and put in his account.

Your case worker at SSI should be able to tell you exactly what she is receiving.  Also I know someone who gets this SSI benefit for their child from the other parent's SSI benefit.    The other parent is not the NCP either.  The grandmother is the NCP.


Okay on your federal income tax it is not counted as wages/salary it is counted under social security.  If you look at an on the form there's a formula for figuring it and you don't have to pay taxes but on a small portion of it.

IF and and say IF the NCP is getting SSI disability through the social security office, you need to call the social security office first and set up an appointment.  The Social Security office will probably TRY to brush you off, but be INSISTENT that you get an appointment to discuss your CHILD's share.

Lots of times the NCP will CLAIM they have the child, and if the child is the mother, the Social Security office will not verify the mother has custody.

The main thing is to be persistent.  You will need a copy of the following your childs social security card, birth certificate and a certified copy of your court order to PROVE you are the CP.

You can call the Financial Management Service of the Department of Treasury at 1-800-304-3107 to find out if your tax refund will be intercepted.

If you did not file an Injured Spouse claim with your tax return and your tax refund was intercepted, you have six years to file an Injured Spouseclaim and get back your portion of the tax refund.

Texas had a new law enacted last year.  If a CP gets more than $750 per month in C/S  the NCP can require an accounting of what the money is spent on for the children.

Don't know exactly how this works and if other states have a law similar to this or not.

First off you need a copy of ALL the child support you've paid from day one and who it was sent to.

You can call the Attorney General's office and they will be able to direct you where you can get this.   Different areas have the different records.

And then start hitting the Attorney General's office with emails.  I learned that calling the Texas AttorneyGeneral's office gets you nowhere...in one ear and out the other.  But sending emails to everybody and their dog will get somebodies attention.

Do you know who your case worker is?  Do you have a CIN number?  A Case Number?  Be sure to reference all that stuff in your email.

Some of these people may not be there anymore, but it's a start at least.

Of course you know Greg Abbott is the Attorney General, Cynthia Bryant is the asst. Attorney General. and Kathy McMichael is under them.
Kathy is probably the person you will hear from.

If you get an email back either add the cs after the @ OR DROP IT.... if you talk with anyone their email would be their first name and a dot and their last name and then @cs.oag.state.tx.us

As some of you may have read before, cousin is in custody battle with grandparents of daughter and bipolar mother, that's on probation for giving child cocaine.

Mother has been drawing SSDI from the state since August 2003, and been claiming daughter also.  This was illegal and cousin will now get daughter's portion since more can't work and pay child support.

I would love to be a FLY on the wall when mother and grandparents get letter telling them they are getting less and will have to PAY BACK all that got illegally

If your ex has set a precedent by meeting you half way for a certain period of time, then I would think her changing her mind at this point will be for nothing.

The Judge will probably order the half way meeting and you and your attorney should show she has done this all along and set this precedent.

In my case I drove both ways, then the mother moved and I was still driving both ways, even though the order said I should pick up and  the mother should fetch.  When the Judge asked me why I was doing all the driving I said because she didn't have a car.  Judge then asked if she had a car and of course she said yes she had one now.  So it was changed to me picking up and her fetching.  

Once I got sole custody she has to do all the driving back and forth, until such a time as I move from the county I'm in, then it will revert back to me one and her the other way.
